Terms of Use

These Terms of Use ("Terms") are an agreement between you and the developer of My Track Record, Andrew Leach ("My Track Record", "we", "us", or "our") and govern your use of the My Track Record mobile application and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Health disclaimer — please read.

My Track Record is a tracking and estimation tool, not a medical device or a source of medical, nutritional, or fitness advice. All calorie, macronutrient, metabolic-rate, readiness, and goal figures are estimates and may be inaccurate, and the written answers are produced by an AI model from your data and can be wrong. Always consult a qualified healthcare professional before changing your diet, exercise, or health routine, and before using calorie targets if you are pregnant, under 18, have a medical condition, or have a history of disordered eating. Never disregard professional advice because of something in My Track Record. The app is built with floors: it never suggests a daily calorie target below 1,200 kcal (1,500 for men), never more than 25% below your estimated maintenance, and it warns rather than pushes when your intake looks too low for your training. Those floors are guardrails, not medical guidance.

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use My Track Record, and if you are under 18 you should use it with a parent or guardian's permission. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

My Track Record lets you log meals, workouts, hydration, and body weight by voice, by typing, by scanning a barcode, and by photographing a meal, a nutrition label, a restaurant menu, a grocery receipt, or a recipe (or importing a recipe from a web address). It can also read daily summaries from Apple Health, detect workouts from your heart-rate data, answer questions about your log, write recaps and fuelling plans, and generate workouts, training plans, and meal-prep batches. Your recordings, the photos you submit, and — for the analysis features — a summary of your log and health data are transcribed and/or analyzed by third-party AI providers to produce structured entries, estimates, and written answers, as described in our Privacy Policy. The Service depends on these providers and on your internet connection, and may occasionally be unavailable, delayed, or produce imperfect results. Entries built from your voice, your typing, or a photo are AI estimates: a word can be misheard, a portion misjudged, a calorie count off. Review your entries — every one can be edited — and do not rely on a figure you have not checked where it matters. Data read from Apple Health is used only for the features described in our Privacy Policy, never for advertising, and is never sold. You may also bring your history from another tracker by pasting its export; those rows become ordinary entries in your account and count as your content under Section 6.

Core features are free to use: voice and typed logging, barcode scanning, the photo and scan features (meal, nutrition label, menu, receipt, and recipe — subject to the allowance in section 4a), the calendar and day views, daily summaries, metabolic-rate and net-calorie calculations, goals, Apple Health sync, the detected-workout feature, the optional location features, history import, Themes, the guided workout runner and its personal records, CSV export of your log, and a small monthly allowance of the Ask and Fuel analysis features. Certain features ("Pro") require a paid subscription, currently including the Plan tab (workout-plan mode), Recap, the Insights board and its in-depth analysis (Ask and Fuel beyond the free monthly allowance; recovery and readiness; the Body, energy, macronutrient, and training-load views; and the micronutrient report), the training planner, workout generation, meal-prep batches and grocery lists, some reminder types, larger allowances under section 4a, and the PDF export report. We may change which features are free or Pro over time; a change does not take away entries you have already logged.

4a. Fair use of AI features

The AI features carry a real per-use processing cost. To keep the Service sustainable and to prevent abuse, your use of them is subject to fair-use limits, which we may set, change, or enforce at any time. As of the "Last updated" date above:

These figures are current limits, not guarantees, and we may adjust them. Normal personal use will not approach the Pro limits. To protect the Service from abuse, each AI feature also has a short-term rate limit (for example, a set number of voice transcriptions per hour) well above normal use; when one is reached, the app asks you to try again later.

5. Subscriptions, billing, and cancellation

Subscriptions purchased through the Apple App Store are also subject to Apple's standard Licensed Application End User License Agreement (the "Apple EULA").

5a. The earned month

This is the promise we make to Pro subscribers, and exactly how it works. It is a promotional offer on our part, not a warranty; nothing in it limits any right the law gives you.

5b. The founder price

The first 200 subscribers can buy Pro annual at the founder price shown in the app ($69.99 per year in the United States), and that price is theirs for as long as their subscription stays active and unbroken: it is not raised when our regular prices are. It is an annual subscription that renews at the founder price until you cancel — not a one-time or lifetime purchase. There are 200 places; a place is taken when a founder subscription starts, including its free trial if you are offered one, and the app shows how many remain. The count updates within a couple of minutes, so a purchase that goes through right as the last place is shown as taken is honoured. If the subscription lapses, expires, or is cancelled and later re-subscribed, the founder price ends with it and any new subscription is at the then-current price. The founder price is tied to the store account and subscription it was bought on; it is not transferable to another person or account, has no cash value, and is not a discount on anything already paid. A refund releases the place. Everything else in this section — billing, renewal, cancellation, and refunds — applies to a founder subscription exactly as to any other.

6. Your content

The data you log belongs to you. By using the Service, you grant us a limited license to store, process, and transmit your data solely to operate and provide the Service to you — including sending your voice recordings, transcripts, the photos you submit, and — for the analysis features — a summary of your log and any connected Apple Health data to our AI providers for processing, as described in our Privacy Policy. We do not claim ownership of your content and we do not sell it.

The Service relies on third-party providers (including, among others, Supabase, OpenAI, Anthropic, RevenueCat, Apple (including Apple Health and Apple's maps and geocoding services), Google, Expo, Resend, Open Food Facts, and the USDA FoodData Central database). Your use of features that depend on them may also be subject to their terms. We are not responsible for the acts or omissions of third-party providers.

9. Intellectual property

The My Track Record app, name, branding, and software are owned by us and protected by intellectual-property laws. These Terms do not grant you any rights to our trademarks or branding. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that any estimate it produces is accurate. You use the Service at your own risk.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY TRACK RECORD AND ITS DEVELOPER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR USD $50. Some jurisdictions do not allow these limits, so they may not fully apply to you.

11a. Your responsibility to us

If someone brings a claim against us because of your misuse of the Service, your breach of these Terms, or content you submit that infringes someone else's rights or breaks the law, you agree to cover our reasonable costs of dealing with that claim, including reasonable legal fees. This does not apply to claims that arise from our own breach of these Terms or our own negligence.

11b. Terms that apply to the Apple App Store version

If you downloaded My Track Record from the Apple App Store, these additional terms apply, and Apple requires us to tell you:

12. Termination

You may stop using the Service and delete your account at any time from Settings → Account → Delete account. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 6, 9, 10, 11, 11a, 11b, 13, and 16) will continue to apply. Before deleting your account you can export your log as a CSV file (Settings → Health & data → Export).

13. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. If you have a dispute with us, please email us first at aleach95@gmail.com; most problems can be sorted out in a reply, and we ask for 30 days to try before either of us goes further. Any dispute that is not resolved that way will be brought in the state or federal courts located in Colorado, except where applicable law gives you the right to bring a claim elsewhere (including in small-claims court, or in your home country if you are a consumer in the European Union or the United Kingdom).

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. General

These Terms, together with our Privacy Policy, are the whole agreement between you and us about the Service. If any part of them is found unenforceable, the rest still applies. If we do not enforce a part of them at some point, that is not a waiver of it later. You may not transfer your rights under these Terms to anyone else; we may transfer ours to a successor that takes over the Service, and we will tell you if we do. Nothing in these Terms takes away rights that consumer law in your country gives you and that cannot be excluded by agreement.
